1. Acceptance of Terms
By accessing and using the A42 House website (a42.art) and services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. A42 House is owned by the Institute for Creative Repair NPC and operated by Creative Repair Studio (Pty) Ltd, both registered in South Africa.
2. Services
A42 House provides accommodation bookings, experience bookings, membership services, and venue hire through this platform. All services are subject to availability and may be modified or discontinued at our discretion.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old to create an account and make bookings.
- You are responsible for all activities that occur under your account.
4. Bookings & Payments
4.1 Stay Bookings
- All stays require a minimum of 2 nights.
- Prices are displayed in South African Rand (ZAR) and include VAT where applicable.
- Booking confirmation is subject to availability and payment processing.
- Check-in is from 14:00 and check-out is by 10:00 unless otherwise arranged.
4.2 Experience Bookings
- Experiences are subject to minimum participant numbers and may be rescheduled.
- Member pricing applies only to active members with a valid membership.
4.3 Payments
- All payments are processed securely through Paystack.
- We accept card payments and bank transfers as facilitated by Paystack.
- Payment must be received in full to confirm a booking.
- Paystack processing fees are non-refundable. In the event of a refund, Paystack transaction fees will be deducted from the refund amount.
5. Cancellation & Refund Policy
For the full details of our cancellation and refund policy, please refer to our dedicated Refund & Cancellation Policy page. A summary is provided below.
5.1 Stays
- More than 7 days before check-in: Full refund, less Paystack processing fees.
- Within 7 days of check-in: 50% of the booking amount is charged. The remainder is refunded, less Paystack processing fees.
- No-show or same-day cancellation: Charged in full. No refund.
5.2 Experiences
- More than 48 hours before the event: Full refund, less Paystack processing fees.
- Within 48 hours of the event: Non-refundable. A credit towards a future experience may be offered at our discretion.
- No-show: No refund or credit.
5.3 Memberships
- Monthly membership fees already paid are non-refundable.
- Cancellation takes effect at the end of the current billing cycle.
5.4 General
- Refunds are processed to the original payment method within 5–10 business days.
- Paystack processing fees are non-refundable and will be deducted from all refunds.
- If A42 House cancels a booking due to unforeseen circumstances, a full refund (including Paystack fees) or rebooking will be offered.
6. Membership & Points
- Membership tiers (Friend, Patron, Guardian) offer different benefits and pricing as displayed on our membership page.
- Points are earned through bookings, events, and membership activity as outlined in our points system.
- 1 point equals R 0.50 in redemption value.
- Points may be redeemed for up to 50% of a stay booking and up to 100% of an experience booking.
- Points expire 12 months after being earned unless otherwise stated.
- Points have no cash value and are non-transferable.
- A42 reserves the right to modify the points system with reasonable notice.
7. House Rules
- A42 House is a heritage property. Guests are expected to treat the space and artworks with care and respect.
- Smoking is not permitted indoors.
- Excessive noise after 22:00 is not permitted.
- Guests are liable for any damage to the property or artworks during their stay.
- Pets are not permitted unless prior arrangement has been made.
8. Intellectual Property
All content on this website — including text, images, logos, artwork, and design — is the property of A42 House, the Institute for Creative Repair, and Creative Repair Studio, or is used with permission from the respective artists and collaborators. You may not reproduce, distribute, or use any content without written permission.
9. Limitation of Liability
A42 House shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount paid for the specific booking or service in question. This does not affect your statutory rights under South African consumer protection legislation.
10. Disputes
If you are unhappy with your experience or wish to dispute a charge, please contact us directly. We aim to resolve all disputes amicably and will review each case individually. If we cannot reach a resolution, you retain your rights under the South African Consumer Protection Act (CPA) and may escalate the matter to the National Consumer Commission.
11. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the courts of Johannesburg, Gauteng.
12. Changes to Terms
We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.
